Xbox 360 - Failure and scratched disc

My brother-in-laws Xbox 360 crashed a few weeks ago. Not only did it crash, it scratched the rim of the disc. The disc as shown no longer works. Not only that, we had put his initials on the bottom of the Xbox 360 to make sure it was his when it came back. Microsoft SPECIFICALLY said that the model he received was HIS. Well, the initials were not there. Dust all over it with a weird smoke smell. Anyways, still doesn't run completely right and Microsoft will not pay for the damaged disc. Better support with my Sony IMHO.
